1825 - The will of Samuel Hammond

In the name of God Amen
I Samuel Hammond of Birmingham Heath in the County of Warwick
Gentleman being of sound mind memory and understanding do
make and publish this my last will and Testament in manner
following that is to say first I will and direct that all
my just debts funeral expenses and the expenses of proving
this my will be fully paid and satisfied out of my personal
estate by my Executors hereinafter named
I give and devise all that my messuage tenement or dwelling
house situate and being near Birmingham Heath aforesaid and
now in my own occupation with the ___ lands hereditaments
and appurtenances thereunto belonging unto my nephew John
Turner the Elder of Birmingham aforesaid Button maker his
heirs and assigns to hold the same unto him the said John
Turner the Elder his heirs and assigns for ever charged and
chargeable nevertheless with the payment of the sum of one
thousand and three hundred pounds to my sister in law Elizabeth
Townsend the Elder her executors administrators and assigns
by the instalments following that is to say the sum of one
hundred pounds immediately after my decease and the residue
thereof within twelve months from the time of my decease and
it is my will and I do hereby declare that the said John Turner
the Elder his heirs and assigns shall and do permit and suffer
my sister in law the said Elizabeth Townsend the Elder to
occupy and enjoy the said dwelling house buildings land and
premises together with all the household furniture linen bedding
and other things which may be in and about the same for
the period of twelve months next after my decease without
paying any rent or compensation for the same and I direct
the said Elizabeth Townsend the Elder to help to keep up my
Establishment during that time in the same way as it may be
at the time of my decease according to the directions of a
Codicil to be hereunto annexed
I give and bequeath unto my nephew the said John Turner the
Elder the Grates Chimney Pieces Ovens and _____ _____ and
Bells and Bolts and fastenings to the windows and doors which
may be in the dwelling house before devised to him at the
time of my decease the pots in the Garden one Lead Cistern
in the Inner Yard and one in the Outer Yard with the Lead
Pipes belonging to the same and it is my will that the said
John Turner the Elder shall be at liberty to the purchase
the fixtures in the said dwelling house and premises at the
valuation of some person to be mutually chosen by him and
my Executors hereinafter named and in case the said John
Turner the Elder shall decline purchasing the said fixtures
then I desire my Executors will sell the same and apply the
money arising therefrom as part of my personal estate
Also I give and bequeath unto the said Elizabeth Townsend
the Elder all my linen sheets table cloths napkins towels
wearing apparel and made ____ to and for her own absoloute
use and benefit
Also I give and bequeath unto the said John Turner the Elder
for and during the term of his natural life the use of
the plate presented to me by the Birmingham Mining and Copper
Company and from and after his decease I give and beqeath
the same to my grand nephew William Hammond Turner absolutely
Also I give and bequeath unto my friends John Webb of
Birmingham Draper Peter Sampson of the same place dealer in
metals my nephew the said John Turner the Elder and John Dickenson
of Birmingham aforesaid Button maker all the rest and residue
of my household furniture and all my personal estate and effects
of what nature or kind soever (except what I do by this
my will and my said codicil specifically dispose of) to hold
to them the said John Webb Peter Sampson John Turner the Elder
and John Dickenson and the survivors or survivor of them
his executors adminstrators and assigns upon trust that they
my said trustees and the survivors and survivor of them his
executors and adminstrators do and shall as soon as conveniently
may be after my decease collect and get in such part thereof
as may consist of debts due to me and within twelve months
after my decease to sell and dispose of such other part thereof
as may be in its nature saleable for the most money that can
be obtained for the same and from and out of the produce and
monies to arise by the means aforesaid do and shall in the
first place pay and satisfy all bond and other debts that
may be then due and owing from me at the time of my decease
and from and after full payment and discharge thereof do and
shall stand interested in the said residue and remainder thereof
upon the trusts hereinafter mentioned and to enable them
my said trustees and the survivors and survivor of them his
executors and adminstrators to pay and satisfy the several
bequests and annuities hereinafter by me bequeathed that
is to say
I give and bequeath unto my said trustees the sum of two
hundred pounds upon trust that they my said trustees and the
survivors and survivor of them his executors and administrators
do and shall place out the same at Interest on real Government
or Leasehold securities and from time to time to call in reinvest
and replace out the same as they or the survivors or survivor
of them shall think proper and to pay the interest dividends
and annual produce thereof unto my niece Mary Testor by
two equal half yearly payments each year during the course
of her natural life and after her decease then upon trust
to pay and divide the said sum of two hundred pounds and the
interest dividends and produce thereof then set for the same
unto and equally amongst such of her children as may be living
at the time of her decease and the survivors and survivor
of them share and share alike
Also I give and bequeath unto my said Trustees the further sum of one hundred and fifty pounds upon trust that they
my said trustees and the survivors and survivor of them his
executors and adminstrators do and shall place the same out
at interest on real Government or leasehold security and from
time to time call in reinvest and replace out the same as
they or the survivors or survivor of them his executors or
adminstrators shall think right and to pay the interests dividends and annual produce thereof unto my niece Mary Hammond
widow of my late nephew Thomas Hammond deceased by two equal
half yearly payments each year until the youngest son
attains the age of twenty one years and from and after
the youngest son then living shall have attained that age
then upon trust to pay and divide the said sum of one hundred
and fifty pounds and the interest dividends and annual produce
thereof then due for the same unto and equally amongst her
children Thomas Hammond David Hammond and Charles Hammond the survivors and survivor of them share and share alike
And also I give and bequeath
to my said trustees the further sum of one hundred and fifty
pounds upon trust that they my said trutees and the survivors
and survivor of them his executors and administrators do and
shall place out the same at interest on real or Government
or leasehold securities and from time to time to call in reinvest and replace out the same as they or the survivors
or survivor of them his executors or administrators shall
think right and pay the interest dividends and annual produce
thereof unto Mary Hammond the widow of my late nephew Joseph
Hammond deceased the son of my brother Thomas Hammond by two
equal half yearly payments in each year for the benefit support
and maintenance of herself and such of the children she has
had by him as may be living at the time of my decease and
the issue of such child which may be dead leaving issue (such
issue taking only a parents share) until the youngest of the
youngest of the children of the said Mary Hammond shall have
attained the age of twenty one years and for the benefit
support and maintenance of the said children and such issue
as aforesaid alone in case the said Mary Hammond shall depart
this life before the youngest of the said children shall have
attained the age of twenty one years and when and so soon
as such youngest child of the said Mary Hammond shall attain
the age of twenty one years upon trust that they my said trustees
and the survivors and survivor of them his executors and administrators
do and shall distribute and divide the same sum of one
hundred and fifty pounds and all interest then due for the
same unto and amongst such of the said child or children as
may be then living and the issue of any of them as may be
then dead leaving issue in equal shares and proportions such
issue to take only such share and proportion as his her or
their father or mother would have been entitled to if living
And I do hereby direct my said trustees to invest and place
out the sums hereinbefore given and bequeathed to them upon
the trusts aforesaid within eighteen calendar months after
my decease except the sum of one hundred and fifty pounds given and bequeathed to the children of Joseph Hammond
which I direct shall be invested within three months from
the time of my decease
I give and bequeath unto my niece Elizabeth Townsend by the
request of my late dear wife the sum of five hundred pounds
to be paid when and as soon as it meets with the approbation
and consent of her Mother and her trustee Mr John Dickenson
Also I give and bequeath unto my nieces Jane and Mary Ann
Turner by the request of my dear wife the sum of two hundred
pounds each
Also I give and bequeath unto my niece Sarah Kite of Cavell
(?) in Ireland daughter of my late sister Sarah Dutton the
sum of one hundred and fifty pounds
I give and bequeath unto my niece Mary Hammmond daughter of
my brother Thomas Hammond the sum of fifty pounds
Also I give and bequeath unto my nephew William Emery Hammond
the sum of thirty pounds
Also I give and bequeath unto my niece Ann Hitchens the sum
of twenty pounds
Also I give and bequeath unto Samuel and Jane Hammond children
of my late nephew Bonham Hammond the sum of twenty pounds
each
Also I give and bequeath unto my grand nephew John Turner
the younger the sum of one hundred pounds
Also I give and bequeath unto my nephew John Townsend two
volumes of Brown's self interpreting Bible two volumes of
Johnson's Dictionary also Dr Owen on the Holy Spirit by George
Burdett (?)
Also I give and bequeath unto my nephew Henry Townsend the
Revd Mr Coril's works by the Reverend Josiah Pratt and Mr
Wilberforce's practical view of professing Christians
Also I given and bequeath unto my niece Elizabeth Townsend
the sum of one hundred and and fifty pounds also one dozen
of silver tea spoons my silver tea pot and stand caddy sugar
basin and cream jug
Also I give and bequeath unto my sister Elizabeth Townsend
the sum of one hundred pounds to purchase household goods
also my table service of china and best set of china tea things
the fine piece and large family prayer book
also I give and bequeath unto the two children lawfully begotten
left by my late nephew William Dutton son of my late sister
Sarah Dutton the sum of ten pounds each and in case of the
death of either of them leaving lawful issue then I give and
bequeath the legacy of such one so dying to such issue in
equal shares and proportions but in case of the death of such
one without leaving lawful issue then I give and bequeath
the legacy of the one so dying to the survivors executors
andministrators and assigns
Also I give and bequeath unto William Turner
James Turner Samuel Turner Henry Turner Alexander Turner and
Maria Bawds(?) the sum of five Guineas each and to Samuel
Turner my silver watch
Also I give and bequeath unto my sister Elizabeth Townsend
and the said John Dickenson the sum of two hundred pounds
upon trust that they the said Elizabeth Townsend and John
Dickenson do and shall place the same out at interest on Government
real or leasehold security and from time to time to call in
reinvest and replace out the same as they or the survivor
of them his or her executors or administrators shall think
right and pay apply and dispose of the interest dividends
and annual produce thereof unto and towards the benefit education
and maintenance of Eliza Townsend daughter of John and Mary
Townsend until she shall attain the age of twenty one years
when and so soon as she shall attain that age in trust to
call in the said sum of two hundred pounds and pay the same
and all interest that may be then due for the same unto the
said Eliza Townsend and her assigns
But in case the said Eliza Townsend shall depart this life
before she attains the age of twenty one years without leaving
lawful issue then upon trust that they the said Elizabeth
Townsend and John Dickenson and the survivor of them his or
her executors or administrators do and shall immediately after
the decease of the said Eliza Townsend pay the said sum of
two hundred pounds and any interest then due thereon unto
the said John Townsend and Mary Townsend or the survivor of
them his or her executors administrators and assigns
Also I give and bequeath unto my sister Elizabeth Townsend
and the said John Dickenson the further sum of fifty pounds
upon trust that they the said Elizabeth Townsend and John
Dickenson do and shall place the same out at interest upon
Government real or leasehold security and from time to time
to call in reinvest and replace out the same as they or the
survivor of them his or her executors administrators shall
think right and pay apply and dispose of the interest dividends
and annual produce thereof unto and towards the benefit education
and maintenance of Mary Townsend daughter of John and Mary
Townsend until she shall attain the age of twenty one years
and when and so soon as she shall attain that age in trust
to call in the same sum of fifty pounds and pay the same and
all interest that may be then due for the same unto the said
Mary Townsend and her assigns
But in case the said Mary Townsend shall depart this life
before she attains the age of twenty one years without leaving
lawful issue of her body then upon the trusts hereafter mentioned
Also I give and bequeath unto the said Elizabeth Townsend
and John Dickenson the further sum of fifty pounds upon
trust that they the said Elizabeth Townsend and John Dickenson
do and shall place the same out at interest on Government
real or leasehold security and from time to time to call in
reinvest replace out the same as they or the survivor of them
his or her executors or administrators shall think right and
pay apply and dispose of the interest dividends and annual
produce thereof unto and towards the benefit education and
maintainence of John Townsend son of the said John and Mary
Townsend until he shall attain the age of twenty one years
and when and so soon as he shall attain that age in trust
to call in the said sum of fifty pounds and pay the same and
all interest that may be then due for the same unto the said
John Townsend and his assigns
But in case the said John Townsend shall depart this life
before he attain the said age without leaving lawful issue
of his body
then upon the trust hereafter mentioned and in case of the
death of either of them the said Mary Townsend and John Townsend
children of the said John Townsend and Mary Townsend before
attaining the age of twenty one years and without leaving
issue as aforesaid then as to the said several sums of fifty
pounds and fifty pounds so given as aforesaid upon trust that
they the said Elizabeth Townsend and John Dickenson and the
survivor of them his executors and admors do and shall pay
and apply the same sums and all interest which may be then
due thereon equally between the survivors and survivor of
them the said Eliza Townsend Mary Townsend and John Townsend
in equal shares and proportions and in case all of them the
said Eliza Townsend Mary Townsend and John Townsend shall
depart this life without leaving lawful issue of his her or
their bodies before he she or they shall have attained their
respective ages of twenty one years then upon trust that they
the said Elizabeth Townsend and John Dickenson and the survivor
of them his or her executors or administrators do and shall
pay the said sums of fifty pounds and fifty pounds and all
interest which may be then due thereon unto the said John
Townsend
his executors administrators and assigns
Also I give and bequeath unto the said John Webb Peter Kempson
John Turner and John Dickenson the sum of fifty pounds upon
trust and to the intent that they or the survivors or survivor
of them his executors or administrators do pay the same to
the Treasurer or Assistant Treasurer of a Society in Birmingham
aforesaid who call themselves the Committee of the Blue Coat
Charity School which sum I charge upon my personal estate
and desire it may be applied to the Charitable uses of the
said school
Also I give and bequeath unto the said John Webb Peter Kempson
John Turner and John Dickenson the sum of twenty pounds upon
trust and to the intent that they or the survivors or survivor
of them his executors or administrators do pay the same to
the Treasurers or Assistant Treasurer of a Society who call
themselves "The British and Foreign Bible Society"
which sum I charge upon my personal estate and desire it may
be applied to the uses of the said society
All which before mentioned legacies I direct shall be paid
within eighteen calendar months after my decease and to such
of my legatees who shall have attained the age of twenty one
years (except the legacies to Samuel Hammond and Jane Hammond
children of the late Bonham Hammond which are not to be paid
till they attain the age of twenty two years) and the legacies
of such of them who shall not have attained that age I
direct shall be placed out at interest by my said executors
and the survivor and survivors of them his executors and
administrators until they shall attain that age and the interest
to arise therefrom in the meantime I direct to be applied
by them towards their education and maintenance
Also I give and bequeath unto my niece Mary Testar the sum
of ten pounds for mourning
Also I give and bequeath unto my niece Mary Hammond wife of
my late nephew Thomas Hammond the sum of ten pounds
Also I give and bequeath unto my sister in law the said Elizabeth
Townsend the Elder and Elizabeth Townsend the Younger
the sum of five pounds each to buy them mourning
Also I give and bequeath unto my nephews John Townsend and
Henry Townsend the sum of ten pounds each
And I give and bequeath mourning rings of the value of two
pounds each to the following persons my sister Elizabeth Townsend
and her daughter Mary Townsend wife of my nephew John Townsend
[blank] Turner wife of my nephew John Turner the Elder and
[blank] Dickenson wife of the said John Dickenson and Mary
Hammond daughter of my brother Thomas Hammond all which said
last mentioned legacies I direct to be paid within three months
after my decease and after full payment and satisfaction of
the legacies and annuities by this my will bequeathed to the
several legatees aforesaid
Then I give and bequeath all the rest and residue of my personal
estate and effects whatsoever and wheresoever and of what
nature or kind soever (except such part as I may dispose of
by the Codicil to be hereunto annexed) and my four shares
in the Tavistock and Mineral Concern unto my said nephew the
said John Turner the Elder and my sister in law the said Elizabeth
Townsend the Elder equally to be divided between them share
and share alike
I give and bequeath the two uppermost kneelings or sittings
numbered 1 and 2 and the lowermost sitting numbered 7 of my
seat numbered 55 in the west aisle of Saint Mary's Chapel
in Birmingham to my nephew the said John Turner the Elder
I give and bequeath three kneelings or sittings numbered 3,
4 and 5 in the same seat to my sister Elizabeth Townsend and
I give and bequeath the remaining kneeling or sitting numbered
6 in the same seat to my niece Mary Hammond daughter of my
brother Thomas Hammond
I give and bequeath two kneelings belonging to me in Ashted
Chapel near Birmingham to my nephews the said John Townsend
and and Henry Townsend for their own use and benefit and I
do hereby direct my said trustees and executors and the survivors
and survivor of them their executors and administrators and
they and each of them are hereby empowered to deduct and
retain out of the money that shall come to their or any
of their hands by virtue of the trust aforesaid all such costs
charges and expenses as they or any of them shall pay sustain
or be put unto in or about the execution of this my will
or any other trusts relating thereto and that they or any
of them shall not be answerable or accountable for the other
or others of them or for the acts deeds receipts payments
or defaults of the other
of them but each for himself only and his own acts deeds neglects
receipts or defaults
and I do hereby further direct that the trustee or trustees
who shall ____ ____ immediately act and be employed in the
receipts and disbursements of the said trust estate and the
interest and produce thereof shall be paid and allowed out
of the trust estate such satisfaction for his and their care
and trouble therein as the remainder of the said trustees
shall think proper
And I do hereby nominate consitute and appoint my said
Trustees John Webb Peter Kempson John Turner and John Dickenson executors of this my last will and testament hereby
revoking all former and other will and and wills by me at
any time heretofore made and do declare this only to be
my last will and Testament

have to this my last Will and Testament contained in five
sheets of paper set my hand and seal in manner following that
is to say to the first four sheets thereof my hand and to
this fifth and last sheet my hand and seal the twentieth day

[First codicil]
I Samuel Hammond of Birmingham Heath in the county of Warwick
Gentleman do make and publish this paper writing as a codicil
to my last will and Testament bearing date the twentieth day
of July instant and desire the same may be annexed and
taken as part thereof
Whereas I have in and by my last will and testament directed
that my sister in law Elizabeth Townsend the Elder should
occupy and enjoy the dewlling house lands buildings and premises
situate at Birmingham Heath aforesaid wherein I now reside
together with all the household furniture linen bedding and
other things which might be then in and about the same for
the period of twelve months next after my decease without
paying any rent or compensation for the same
And I did direct the said Elizabeth Townsend to keep up my
Establishment during that time in the same way as at the
time of my decease according to the directions of a codicil
to be thereunto annexed
Now in order to enable my said sister in law Elizabeth Townsend
to keep up my present Establishment for the period of twelve
months after my decease I the said Samuel Hammond do by this
codicil give and bequeath to the said Elizabeth Townsend the
Elder what money and bills of Exchange and promissory
notes I may leave in my house and also the balance which I
may have in the hands of my Bankers at the time of my decease
Also I give and bequeath to the said Elizabeth Townsend the
Elder whatever sum or sums of money may be due and owing to
me at my decease in respect of a certain annuity of one hundred
and twenty five pounds payable to me during my life from Messers
Turner and Sons by two equal half yearly payments upon the
twenty fourth day of June and the twenty fifth day of December
in each year and which is secured by their note of bond
I aso give and bequeath to the said Elizabeth Townsend whatever
sum and sums of money may be due and owing to me at my decease
in respect of a certain annuity of eighty pounds payable to
me during my life from my said nephew John Turner the Elder
by two equal half yearly payments upon the twenty fourth day
of June and the twenty fifth day of December in each year
and which is secured by the bond of the said John Turner the
Elder
Also I give and bequeath to the said Elizabeth Townsend the
Elder the interest due at the time of my decease or which
may become due for twelve months succeeding my decease on
such monies as I may have out at interest on bonds or
other securities and also the interest which may become due
after my decease upon a sum of eight hundred pounds which
is payable to my Executors in six months after the day of
my decease by my nephew the said John Turner the Elder and which said sum and interest is secured by his promissory
note of bond payable to my executors
Also I give and bequeath unto her the dividends or proportion
of dividends which may be due at my decease and that may arise
and become due during the twelve months succeeding my
decease from my shares in the Birmingham Mining and Copper
Company and the old Brass or Metal Company
Also the dividends which may be due at my decease and which
may become due during the twelve months after my decease from
my shares in the Tavistock Canal and Mineral Concern
And it is my will and I do hereby direct the said Elizabeth
Townsend the Elder to pay the levies taxes and assessments
of every kind which may be due at the time of my decease or
that may become due during the said period of twelve months
in respect of the said house buildings and premises except
the aforesaid Kings Taxes which are to be paid by my Executors
and except also my subscriptions to public charities which
I ____ may cease at my decease
It is my will and I do direct the said Elizabeth Townsend
the Elder to discharge all deeds + sums of money that may
be due for housekeeping or other incidental expenses at the
time of my decease
and I do also direct the said Elizabeth Townsend the elder
to pay the servants that may be living with me at the time
of my decease the wages that may be then due to them and also
the wages of such of them as may live with her for the said
period of twelve months
And whereas it was my intention to repair part of the said
dwelling house and outbuildings now occupied by me for which
purpose I had prepared a quantity of timber now it is
my will and I do direct that the said John Turner shall repair
the same immediately after my decease
And I give and bequeath to him the timber already prepared
by me for that purpose as aforesaid
And also I give and bequeath to the said John Turner the Elder
out of the residue of my estate and effects prior to the division
thereof between the said John Turner the Elder and Elizabeth
Townsend the Elder the sum of fifty pounds
I give to my servant James Maykirk all my Clothes and wearing
apparel (except my linen and flannels)
I give to each of the servants living with me at the time
of my decease a decent suit of mourning with a legacy of one
Guinea each
I give and bequeath to the said Elizabeth Townsend the Elder
my four shares in the Old Union Mill and Bread Company for
her own use and benefit
I give and bequeath to my niece Mary Hammond widow of Thomas
Hammond two sittings in Saint James's Chapel Ashted numbered
3 and 4 and to my nephew Henry Townsend one sitting in addition
to those given him by my will hereinbefore mentioned
I do hereby expressly declare and direct that the appointment
of my nephew John Turner the Elder as Trustee and Executor
of my will shall not cancel extinguish or release the sum
or sums of money in which he now is indebted or at the
time of my decease shall be indebted to me but that the same sum or sums of money shall be paid by him to my other
trustees and executors in like manner as if he had not been
appointed such trustee and executor
And I do hereby appoint Mr John Dickenson of Birmingham to
be an advisor of the said Elizabeth Townsend the Elder and
to act with her in the execution of this my Codicil as well
as such parts of my will in which he is mentioned
In witness whereof I the said testator Samuel Hammond have
to this my Codicil to my last will and testament contained
on two sheets of paper set my hand and seal in manner following
that is to say to the first sheet hereof my hand and to
this second and last sheet my hand and seal the twenty eighth

I Samuel Hammond of Birmingham Heath in the County of Warwick
Gentleman do make and publish this paper writing as a Codicil
to my last will and Testament bearing date the twentieth day
of July one thousand eight hundred and twenty and desire the
same may be annexed to and taken as part thereof
Whereas I have in and by my said last will and Testament given
and devised all that my messuage tenement or dwelling house
situate and being at Birmingham Heath aforesaid then and now
in my own occupation with the buildings lands hereditaments
and appurtenances thereunto belonging unto my nephew John
Turner the Elder of Birmingham Button maker his heirs
and assigns to hold the same unto him the said John Turner
the Elder his heirs and assigns for ever charged and chargeable
neverthe[less] with the payment of the sum of one thousand
and three hundred pounds to my sister in law Elizabeth Townsend
the Elder her executors administrators and assigns by the
instalments and in manner therein mentioned and whereas I
have also in and by my said last will and Testament given
and bequeathed to my grand nephew John Turner the younger
the sum of one hundred pounds who hath since departed this
life and whereas I have also in and by my said last will and
testament given and bequeathed to Maria Dawes the sum of five
Guineas who hath also since departed this life
Now I the said Samuel Hammond do by this my codicil confirm
the said gift and devise of my said messuage tenement
or dewelling house with the buildings land hereditaments and
appurtenances thereunto belonging unto my nephew the said
John Turner the Elder his heirs and assigns
But I do revoke and make new the charge of the sum of one
thousand and three hundred pounds to which the same [xxx]
is made liable by my said will and I do hereby declare that
it is my will and that the same shall stand charged and chargeable
only with the payment of the sum of one thousand pounds (instead
of the sum of one thousand and three hundred pounds) to my
sister in law the said Elizabeth Townsend the Elder to be
paid in manner following that is to say the sum of one hundred
pounds part thereof immediately after my decease and the sum
of nine hundred pounds the residue thereof within twelve months
from the time of my decease
I give and bequeath the sum of five Guineas so given and bequeathed by my said will to the said Maria Dawes unto my
servant Louisa Butler
I also give and bequeath the sum of one hundred pounds so
given and bequeathed by my said will to my said John Turner
the younger (deceased) unto my nephew the said John Turner
the Elder his executors administrators and assigns upon trust
to apply the same unto and for the benefit of the child and
children of the said John Turner the younger deceased in such
way as to him or them shall seem best
And I do hereby ratify and confirm my said will in every other
respect

I Samuel Hammond of Birmingham Heath in the County of Warwick
Gentleman do make and publish this paper writing as a third
codicil to my last will and testament bearing date the twentieth
day of July one thousand eight hundred and twenty and desire
the same may be annexed to and taken as part thereof
Whereas I have in and by my said last will and Testament given
and bequeathed unto my sister Elizabeth Townsend the Elder
and John Dickenson their executors administrators and assigns
certain sum and sums of money upon the trusts therein particularly
mentioned concerning the same
And whereas I did in and by a certain codicil to my said will
bearing the date the twenty eighth day of July one thousand
eight hundred and twenty appoint the said John Dickenson to
be an advisor to the said Elizabeth Townsend the Elder and
to act with her in the execution of that my codicil as well
as in such parts of my said will in which she was mentioned
and whereas the said John Dickenson hath since departed this
life
Now I the said Samuel Hammond do by this my codicil give and
bequeath all and every such sum and sums of money as once
given to the said Elizabeth Townsend the Elder and John Dickenson
their executors admors and assigns in and by my said last
will and Testament unto the said Elizabeth Townsend the Elder
and Peter Kempson of Birmingham aforesaid Dealer in metals
their executors and administrators upon the same trusts and
for the same purposes as that same were given and bequeathed
to the said Elizabeth Townsend the Elder and John Dickenson
And I do direct that the said Peter Kempson shall have full
power and authority to act in the trusts of my said will and
that the said estate and interests vested in the said
John Dickenson shall be and is hereby vested in him the said
Peter Kempson as fully and effectually to all intents and
purposes jointly with the said Elizabeth Townsend the Elder
as he could and might have done and the same estate and interest
___ or interests or might have vested in case his name had
been inserted with the name of [the said] Elizabeth Townsend
the Elder instead of the name of the said John Dickenson
And I do ____ appoint the said Peter Kempson to be an advisor
of the said Elizabeth Townsend the Elder in the stead of the
said John Dickenson and to act with her in the execution of
my said codicil as well as such parts of my will in which
he is mentioned
And I do hereby give and bequeath to my sister the said Elizabeth
Townsend the Elder her executors administrators and assigns
all my household goods plate china glass and furniture that
may be in and about my dwelling house at the time of my decease
(except such parts thereof as I have by my said will specifically
disposed of) and also all my farming stock ricks of hay and
corn and implements of husbandry garden tools and utensils
and my cows and pigs horse and gig and gig harness farming
cart and ____ market cart and the ____ belonging thereto and
all other my live and dead stock to and for her own use and
benefit
And as it is not my intention by the bequest now made of my
household furniture to revoke or make void the bequest of
one hundred pounds given by my said will to the said Elizabeth
Townsend the Elder to purchase household goods
I do hereby fully and absolutely confirm the said legacy or
bequest
And I do give and bequeath unto my nephew John Townsend his
executors adminstrators and assigns two of my shares in the
Birmingham Mining and Copper Company to and for his own use
and benefit
And I do hereby ratify and confirm my said will in every other
respect

October one thousand eight hundred and twenty one

is now also dead
Now I do hereby give and bequeath the said legacy [or] sum
of fifty pounds to my nephew Henry Townsend for his own use
and benefit
And I confirm my will and codicils in every respect
